What is a Hospital Opioid Claim?
A Hospital Opioid Claim is an Opioid Claim for an eligible Acute Care hospital defined as: (i) a non-federal acute care hospital, as defined by CMS, or (ii) a non-federal hospital or hospital district that is required by law to provide inpatient acute care and/or fund the provision of inpatient acute care.
Who is a Hospital Opioid Claimant?
A Hospital Opioid Claimant means a Holder of a Hospital Opioid Claim and is the operating entity that owns one or more Acute Care hospitals for which a claim is being filed.
Who is a Holder of a Hospital Opioid Claim?
The Holder of a Hospital Opioid Claim is described in the Plan as the Hospital Opioid Claimant (the “Claimant”) and is required to complete and submit the Claim Form in order to be eligible to receive Hospital Abatement Distributions from the Hospital Trust.
How do I know if I qualify as a Hospital Authorized Recipient?
To qualify as a Hospital Authorized Recipient, a Holder of a Hospital Opioid Claim must certify in its Claim Form that:
(a) It adheres to the standard of care for the emergency department, hospital wards and outpatient clinics at the time of any prospective evaluation, diagnosis, and treatment of Opioid Use Disorder “OUD”, including with respect to the applicable standard of care for the treatment of addiction, acute withdrawal and treatment for OUD with medication assisted treatment; and;
(b) It provides discharge planning and post-discharge care coordination for patients with OUD, including information for appropriate OUD treatment services.
(c) It demonstrates through the Requisite Claims Data that it has been damaged in the past and reasonably anticipates incurring additional abatement expenses in the future arising from patients suffering from OUD; if it does not do so, then it will not receive any Hospital Abatement Distribution.
What do I need to do to qualify for Hospital Abatement Distributions?
In order to qualify as a Hospital Authorized Recipient and be eligible to receive a Hospital Abatement Distribution, Holders of Hospital Opioid Claims (a Hospital Class Member) must comply with the terms, provisions and procedures set forth in the Hospital TDP, including the Hospital Abatement Distribution Claim Form Deadline and the timely submission of all forms and data required pursuant hereto.
How do I know if I am eligible to receive Hospital Abatement Distributions?
To qualify as a Hospital Authorized Recipient eligible to receive Hospital Abatement Distributions from the Hospital Trust, each applicable Holder of a Hospital Opioid Claim must:
(a) Timely submit the Claim Form.
(b) Provide all of the Requisite Claims Data in connection with submitting a Claim Form.

How do I submit the Claim Form, Requisite Claims Data and other required documents and information?
The Trustee (or its agents or representatives) will contact the person listed as the contact on the Registration Form and provide the SFTP instructions within five business days of receipt of sufficient registration information.
Where do I obtain and complete my Hospital Abatement Distribution Registration Form?
A Registration Form can be obtained online and submitted to: registrationform@www.mlnkhospitalsettlement.com.
How do I communicate with the claims administrator?
Communications with the claims administrator should be submitted to: info@www.mlnkhospitalsettlement.com. When doing so, please always state the name of the Acute Care Facility/Hospital for which you are communicating and once you receive your claimant number, please always state this Claimant Number on all communication.
What is the total amount of the money available in the Hospital Trust?
The gross distributions from the Mallinckrodt bankruptcy estate to the Hospital Trust may aggregate up to approximately $45 million, however, that sum is dependent on factors beyond the control of the Hospital Trust and further, (a) that sum is payable over the span of eight years, and (b) that sum will be reduced by the court-approved legal fees allocated for the Ad Hoc Group of Hospitals that negotiated this settlement and its inclusion in the confirmed Plan, as well as certain other associated Hospital Trust expenses. The distributions from the Hospital Trust are also dependent on the number of eligible claims ultimately approved to receive a distribution.
What damages do I need to demonstrate to receive Hospital Abatement Distributions?
A Holder of a Hospital Opioid Claim (a Hospital Class Member) must demonstrate through the Requisite Claims Data that it has been damaged in the past and reasonably anticipates incurring additional abatement expenses in the future arising from patients suffering from OUD; if it does not do so, then it will not receive any Hospital Abatement Distribution.
What do I need to do to register to file a claim?
If you receive the Notice and would like to file a claim, you must download, complete and submit a Registration Form. You will then complete and submit a BAA, Claim Form and Requisite Claims Data using a SFTP.
What do I need to submit in order to qualify to receive Hospital Abatement Distributions?
The Requisite Claims Data information is listed on the Claim Form Exhibit A Question #20.
